Thank you for considering my help. I am Dave Burgio. I run Waypoint Admissions, a solo college admissions consulting practice. Waypoint Admissions is a registered trade name of SteelBase LLC, a Colorado limited liability company (entity 20261465472), and SteelBase LLC is the party you are contracting with. In these terms, "I" and "me" mean me, Dave Burgio, doing business as Waypoint Admissions. "You" means the person who hires me, which is the parent or legal guardian when the student is under 18. "Your student" means the student the work is for.
These terms are the agreement between you and me. By booking a call, submitting an intake form, clicking to agree, or paying for a service, you agree to what is written here, and that counts as your signature. Please read it. If something does not sit right with you, email me at dave@waypointadmissions.com before you pay and we will sort it out.
Most of my students are minors, typically 13 to 18 years old. When the student is under 18, a parent or legal guardian must be the person who signs up, agrees to these terms, and pays. The student is not the contracting party and cannot agree to these terms on their own.
If you are a student who is 18 or older and you are hiring me for yourself, you can contract directly, and everything here applies to you.
When you sign up, you confirm three things. You are at least 18. You are the student's parent or legal guardian, or you otherwise have legal authority to enroll that student and agree to these terms for them. The information you give me is accurate to the best of your knowledge.
If two parents or guardians share decision making, the one who signs up is confirming they have authority to agree on the family's behalf. If a custody order or any other arrangement limits that authority, tell me before we start so I can work within it.
If you are the parent or guardian, you get copies of everything. That means the written deliverables, the intake summaries, and any plan documents I produce. You are welcome on every call. I will never set up a private, parent-excluded relationship with your child.
Everything I do is US undergraduate college admissions strategy for civilian colleges and universities. All of it is delivered virtually, anywhere in the country. I do not hold in-person meetings.
Please schedule your calls and use your follow up window within 12 months of purchase. After 12 months, unused calls from a one time package expire. If life gets in the way and you need more time, email me and I will work with you.
If you want work that falls outside these three products, ask me. If I can help, I will quote it in writing first and you will know the price before anything starts. A written quote I send you becomes part of this agreement for that work.
Payments are processed by Stripe. I never see or store your full card number. Stripe handles that. Prices are in US dollars. You authorize me to charge the card you put on file for the amounts described here. Work begins after payment clears, with the free intro call as the one exception.
The List Check and The Roadmap are one time charges. They do not renew. There is nothing to cancel.
If a renewal payment fails, I will email you and pause the quarterly refreshes until it is resolved. I will not quietly keep retrying forever without telling you. If it is still unresolved after 30 days, I may end the plan, and I will email you when I do.
This is the most important paragraph in this document, so I am putting it plainly.
I do not guarantee admission to any college. I do not guarantee scholarships, financial aid, merit money, a specific net price, a specific major, honors program placement, or any other outcome. Nobody can honestly promise you those things.
Admission decisions rest solely with each institution. Those decisions are made by people I do not control, using criteria that change year to year and that no outside consultant can see fully. Financial aid awards are set by each college and by federal and state formulas. I have no role in setting them.
What I sell is analysis, strategy, and an honest read of where your student stands. What you do with it is up to you. If anyone in this industry tells you they can guarantee a result, walk away from them.
Net cost estimates and admission odds I provide are informed estimates based on the data available to me. They are not promises, quotes, or offers from any college.
Your student is the sole author of every application, essay, short answer, activity description, and supplement they submit. That is a firm line, and I hold it every time.
Here is where the line sits:
Colleges ask applicants to certify that their work is their own. That certification has to be true. If you or your student asks me to cross this line, I will decline, and I may end our engagement.
Some colleges ask whether an applicant worked with an outside consultant. If your student is asked, tell the truth. I will never advise anyone to hide that I was involved.
My work is only as good as what I am working from. So:
I want this to be easy for both of us. Normal life happens, and I am not going to nickel and dime you over a schedule change.
Most of my clients are families with a minor student, so I treat this as the most sensitive part of the whole agreement.
To do the work, I collect student name, grade, high school, GPA, standardized test scores, course rigor, extracurricular activities, intended major, geographic preferences, and parent contact details. If you want net cost modeling, I also collect family financial information at the level needed to estimate aid, meaning income ranges and the factors aid formulas use. I collect this through my web intake forms and, if you agree to recording, from the intro call.
I do not need and I do not want Social Security numbers, tax returns, bank or card numbers, or login credentials of any kind. Please do not send them. If you send me something I did not ask for, I will delete it.
I do not sell your information. I do not share it with third parties for marketing. I do not use it to train any AI model. I do use ordinary business tools to run the practice, including Stripe for payments plus scheduling, email, and file storage tools, and those vendors handle information only so that I can deliver the service to you.
I will not use your student's name, photo, essay, application materials, or admission results in any marketing without your written permission, and you can withdraw that permission at any time.
My Privacy Policy at https://waypointadmissions.com explains what I collect, how I use it, how long I keep it, and how to ask me to delete it. If the Privacy Policy and these terms ever disagree about how information is handled, the Privacy Policy controls.
The roadmap document, school snapshots, and written materials I create for you are yours to use for your family's personal, non-commercial purposes. Share them with your student, your spouse, your student's counselor, a tutor, or a grandparent who is helping pay. That is all fine.
What you may not do is republish them, post them publicly, resell them, or use them to run or support a competing consulting practice. Please do not strip my name off them and distribute them.
Your student's own work stays yours. Essays, drafts, resumes, transcripts, and application content belong to your family. You give me permission to read, mark up, and store those materials for as long as I need them to do the work you hired me for.
I keep all rights to the things I built to make your documents: my templates, my frameworks, my research engine, my underlying database, my methods, and my written materials generally. Buying a deliverable does not transfer any of that to you.
Third party data and school information referenced in my work belongs to whoever published it.
You should know this up front, because it matters.
Separately from Waypoint, I volunteer as a West Point admissions evaluator. That role is unpaid. It is completely separate from this business, and I keep a hard wall between the two.
Specifically:
Waypoint Admissions is not affiliated with, sponsored by, or endorsed by West Point, the United States Army, the Department of Defense, or any college, university, or testing organization. Any school names I mention are for identification only.
I put real care into this work, and I stand behind the effort. I also have to be straight with you about what I can and cannot promise.
My services are provided as is. I do not warrant that my analysis will be error free, that school data will be perfectly current, that my odds estimates will prove accurate, or that my services will meet every expectation you have. College data changes, policies change, and admissions offices change how they read applications without announcing it.
I am not a lawyer, a licensed financial advisor, an accountant, a tax professional, or a mental health professional, and nothing I give you is legal, investment, tax, or clinical advice. Net cost modeling is an estimate to help you plan. For binding numbers, use each college's official cost estimator and financial aid office.
To the fullest extent the law allows, I disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow certain warranty exclusions, so parts of this may not apply to you.
If something goes wrong and you believe I am responsible, here is the ceiling we both agree to.
My total liability to you for anything related to these terms or my services is capped at the total amount you actually paid me in the 12 months before the claim arose. If you paid me $295 in that period, $295 is the cap. If you paid me $1,495, that is the cap.
I am not liable for indirect, incidental, special, consequential, or punitive damages. In plain terms, I am not liable for a denied admission, a lost scholarship, a missed deadline, tuition you end up paying, a gap year, lost future earnings, or emotional distress connected to an admissions outcome.
These limits apply no matter how the claim is framed, in contract, in negligence, or otherwise. They do not apply to anything the law says cannot be limited, including fraud or willful misconduct on my part. Some states limit how far these caps can go, so parts of this may not apply to you.
You can stop working with me at any time. Email me and tell me. The refund rules above decide what happens with money.
I can also end an engagement, and I will do it in writing with an explanation. I would do that if you ask me to cross the academic integrity line, if information you gave me turns out to be deliberately false, if payment fails and is not resolved, or if anyone involved is abusive to me or to my family. In that situation I will tell you what has been delivered and where things stand, and I will refund anything I was paid for and did not deliver.
The sections on academic integrity, information handling, ownership, disclaimers, liability limits, governing law, and disputes survive after the engagement ends.
If you are unhappy, come talk to me first. Email dave@waypointadmissions.com and describe the problem. I will respond, and we will both make a genuine, good faith effort to work it out directly. Please give this at least 30 days before taking any formal step. In my experience, almost everything gets resolved right here.
If we truly cannot resolve it, these terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. To the extent the law allows, any legal action will be brought in the state or federal courts located in Colorado, and we both agree those courts have jurisdiction. Either of us may still use small claims court for a claim that qualifies.
Nothing in these terms takes away a right you have under your own state's consumer protection laws that cannot be waived.
I may update these terms as the practice grows. When I do, I will change the "last updated" date at the top and post the current version at https://waypointadmissions.com.
If a change is significant, and especially if it affects pricing or the auto-renewal terms for The Living Roadmap, I will email you directly at least 30 days before it takes effect. I will not slip a material change past you by quietly editing a web page.
Changes are not retroactive. The terms in effect on the day you paid govern the work you already paid for. If you do not accept a change that affects a renewing plan, cancel before your next renewal date and you will not be charged again.
Email is the best way to reach me, and it is the official channel for cancellations, refund requests, questions about these terms, requests about your student's information, and anything you want documented. I read everything that comes in.
